A&K SPACE TERMS & CONDITIONS

INCLUSIONS

The price of the A&K SPACE 2007 programs INCLUDES:

Accommodations

As shown in the itinerary, based on double occupancy rooms with private bath or shower. Please note that hotel accommodations in Russia for Star City and Baikonur are based on rooms with single bed accommodations.

Meals

As indicated in the itinerary; B = Breakfast, L = Lunch, D = Dinner.

Transfers

As indicated in the brochure, based on private motorcoach or similar transportation.

Baggage Handling

The vehicles reserved for your itinerary can accommodate up to two suitcases and one carry-on bag per person. If you intend to travel with additional luggage, please advise your travel consultant. If larger vehicles with increased storage capacity must be reserved during your tour, you will be advised of extra charges to be paid locally. The internal flight in Russia may have additional baggage restrictions. Inquire with you’re A&K Space travel consultant.

Sightseeing

All sightseeing excursions, as detailed in the itineraries, by private motorcoach. Based on the destination, the transportation and touring vehicles that A&K Space hires are the best available in each respective location. All entrance fees for scheduled sightseeing are also included.

Surface Transportation

Surface transportation for all transfers and scheduled sightseeing has been included as outlined in your brochure itinerary, using private motorcoaches that are the best available in each location.

Russian Internal Air Transportation

Domestic flights within Russia (Moscow/Baikonur/Moscow), operated by the Russian Space Federation, are included in the Soyuz tour price and are subject to change.

Air Transportation

We will arrange the best priced airfare available in the class category you request at the time of your booking. Taxes are not included. All air quotes are subject to change and can carry penalties and/or surcharges, until final payment is received by A&K. Flight confirmation is based on availability. Certain airfares may be subject to a service fee. If you cancel or change your flights, penalties may apply.

Guides

The services of professional English-speaking drivers and guides (or driver-guide, depending on location) are included. These drivers/guides are instructed to follow a specified itinerary.

Taxes, Service Charges

Hotel taxes and service charges imposed for accom­mo­dations and services specified in the itinerary.

Gratuities

Included as specified below:

Russian Soyuz and Cosmonaut itineraries

•  Hotel restaurant wait staff for welcome reception and dinner for first night in Moscow

Although not required anywhere on these brochure programs, tipping is a personal gesture for good service. A&K Space will provide tipping guides in the trip documents packet if/where it may apply.

Immediate Check-In

This has been included in Moscow as passengers are arriving independently. For USA hotels, immediate check-in has not been reserved. Should you wish to have your room ready for immediate check-in for USA itineraries, A&K Space can arrange this for an additional charge. Please ask for details and prices.

EXCLUSIONS

The price of your travel program DOES NOT INCLUDE:

•  Cost of obtaining passports or visas

•  Cost of any required or recommended vaccina-tions or other health precautions

•  Any international or internal scheduled airfares (unless specified in “Inclusions”)

•  Excess baggage or shipping charges

•  Storage and/or transportation of excess baggage

•  Meals (other than those stated in “Inclusions”) or room service charges

•  Personal items such as drinks; laundry; telephone or fax charges; traveller’s insurance;
   equipment rental

•  Excess mileage carried out at the request of the participants

•  Additional driver/guide services

•  Any items not specified under “INCLUSIONS”

Excess Baggage

Baggage weight restrictions are strictly enforced, for reasons of safety as well as the physical capacity of certain aircraft. If your luggage is overweight, you will incur considerable extra costs and your bags can be delayed, as they may not travel with you.

While Abercrombie & Kent will endeavor to protect your property, baggage, personal effects and other possessions are carried at your own risk. Baggage insurance is strongly advised. Premiums are calculated at 8% of the total land and internal air cost.

Early Arrival

For the Russian programs, arriving a day early allows for an additional day to rest and become acclimated to the different time zone. Early arrival is not included. Please ask for rates and details at the time of booking.

A&K Passenger Travel Protection Program

Our specially designed program provides trip cancellation coverage, medical coverage, emergency medical evacuation, protection against lost or damaged luggage, and a toll-free assistance line. This coverage is not included in the tour price and it is strongly recommended. It is easy to purchase. Contact you’re A&K travel consultant for details.

Passports And Visas

Valid passports are required for travel to Russia for US Citizens. Check with your travel agent or A&K for the current visa requirements. Passports must be valid for 6 months after the return of your journey, and you must have sufficient blank pages available for visa and immigration stamps. A&K Space cannot be held responsible should you be denied entry into a country due to non-compliance with these requirements. A copy of your valid passport must be submitted to A&K in order to confirm air reservations for Russian programs. Passport and visa fees are not included in the price of these programs.

Optional Expenses

Charges for extra meals, transport, sightseeing services or other optional additions to your established itinerary are your responsibility and must be paid locally.

Gratuities

Gratuities are not included in your tour price other than those stated in the “Inclusions” statement. Your copy of “Travel Tips” contains suggested gratuity guidelines for your consideration.

Dining With Your Guide

For the Russian programs, on days when dinner has not been included in your itinerary (and in your tour cost), you may, at your discretion, choose to invite your guide to dine with your party. You are under no obligation to do so, but if you do extend such an invitation, the guide is your guest and you will be responsible for the cost of his/her meal.

BOOKING CONDITIONS

These conditions apply to: The Soyuz Space Launch; Cosmonaut Program; Children’s Camp; Family Adventure; Optional Aviation Adventures and zero gravity flights.

Payment

For American programs, a $500 initial deposit is due at the time of booking. For Russian programs, a $1000 initial deposit is due at the time of booking. Final payment is due 60 days prior to departure. If your reservation is made within 60 days of departure, the entire cost of the program must be paid at the time of the request in order to secure confirmation.

Cancellation

When a written cancellation is received by A&K Space more than 60 days prior to departure, the deposit will be refunded less a $500 per person cancellation fee.

Written cancellations received less than 60 days prior to departure are subject to the following forfeit of program cost:

•  59-31 days, 50% of program cost

•  30-0 days of departure, 100% of program cost

Aviation Experiential Flights

For weightlessness flights and high performance jet flights, fair weather conditions are required. The flight operator reserves the right to change flight days and/or times if flying conditions during the scheduled day or time are not acceptable to the pilot and/or aircraft flight operator. A&K Space cannot be held responsible for additional costs associated with changing accommodations, sightseeing, meals, transportation and/or personal arrangements that may be affected by such a change.

Additionally, passengers must first pass a required aviation physical exam. Special G-Force safety suits provided for applicable flights must be worn. On the Russian optional flights, no credit or partial refund will be provided for the Novodevichy Convent and/or Tretyakov Gallery Tours.

Sightseeing

Sightseeing arrangements have been made with these programs’ special interests in mind. The drivers/guides are contracted for A&K Space sightseeing tours. Sightseeing tours are subject to change without notice. In the event that a particular attraction is closed on the day or time of your visit, your guide will offer alternative arrangements.

Sightseeing excursions may include space and/or aviation simulations that allow for participation in space and/or aviation experiences. If an operator determines that a participant is unable to safely complete any/all such experiences (rides, flights, simulators, etc.), they will have right to decline passage or participation.

Insurance

A&K’s Passenger Travel Protection Program, which provides coverage for injury, illness, trip cancellation and loss or damage of luggage and its contents, is strongly recommended. Premiums are calculated at 8% of the total land and internal air cost.

Prices And Arrangements

The tour price includes planning, handling and operational charges. Both 2007 and 2008 programs are quoted in US Dollars at the current rate of exchange and tariff as of January 2007. A&K Space reserves the right to increase tour prices to cover increased costs, tariffs and taxes, and to reflect fluctuations in foreign exchange markets. Devaluation of a foreign currency will be weighed against any tariff increases imposed. A&K Space is under no obligation to give breakdown costs involved in these programs.

Additional expenses incurred due to change, delay or cancellation of any flights, or any delays or events beyond A&K Space’s control, will be the responsibility of the client. Flights are occasionally subject to overbooking or cancellation. If this occurs, Abercrombie & Kent’s correspondent companies will do all possible to assist clients in boarding or finding alternate arrangements. IT MUST BE STRESSED THAT THIS IS DONE AS A COURTESY TO CLIENTS, AND A&K Space CANNOT BE HELD RESPONSIBLE FOR DENIED BOARDING, NOR FOR THE ADDITIONAL COSTS THUS INCURRED, NOR FOR MONIES NOT RECOVERED FOR MISSED LAND ARRANGEMENTS DUE TO AIRLINE DELAYS.

Child Policy

For the Children’s Camp at the US Space & Rocket Center, the program has been designed for ages 10-12. For the Family program at the US Space & Rocket Center, the program has been designed for parents with children ages 8-12. For the weightless flight program operating from Kennedy Space Center, children must be at least 12 years old. For the Russian space-themed programs, children must be at least 12 years old. For suborbital flight aboard the Rocketplane - XP, you must be at least 18 years old.

Photography

A&K Space reserves the right to take photographs during the operation of these programs or part thereof and to use them for promotional purposes. By booking a program with A&K Space, program members agree to allow their images to be used in such photographs. Program members who prefer that their images not be used are required to identify themselves to their Tour Director at the beginning of their program.

Program And Itinerary

A&K Space LLC, and its representatives reserve the right to withdraw any tour or any part of it, to make alterations in the itinerary/program as it deems necessary or desirable without prior notice to the participant; to refuse to accept or retain as a member of the tour any person at any time, and to pass onto tour members any expenditures or losses caused by delays or events beyond its control.

Limits On A&K Space’s Responsibility

A&K Space LLC, its employees, shareholders, officers, directors, successors, agents and assigns (collectively A&K), does not own or operate any entity which is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated Abercrombie & Kent companies). All such persons and entities are independent contractors. As a result A&K Space is not liable for any negligent or willful act of any such person or entity or of any third person.

In addition and without limitation, A&K Space is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, acts of governments and their agencies, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft, spacecraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

There are certain inherent risks in travel of the type involved here. These include, but are not limited to, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.

Travel Advisories And Warnings

It is the responsibility of The Traveller to become informed about the most current travel advisories and warnings by referring to the U. S. State Department’s travel website at www.travel.state.gov/ or by phone at 1-888-407-4747. In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the trip, should The Traveller still choose to travel, notwithstanding any travel advisory or warning, The Traveller assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

Arbitration Agreement

Any controversy or claim arising out of or relating to these Terms and Conditions, to the Limits on A&K Space’s Responsibility clause, to the brochure, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in Chicago, Illinois in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that (a) in lieu of a personal appearance at arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.

Travellers Representation

The Traveller represents that neither he nor she nor anyone travelling with him/her has any physical condition or disability that could create a hazard to himself/herself or other members of the tour. A&K Space reserves the right to decline to accept anyone on a trip. A&K Space reserves the right to remove from the trip, at his/her own expense, anyone whose condition is such that he/she could create a hazard to himself/herself or others, or otherwise impact the enjoyment of other passengers on the trip.

ANY PAYMENT TO A&K SPACE CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN AND IN MORE SPECIFIC PRE-DEPARTURE PASSENGER DOCU­MEN­TATION, INCLUDING THE PASSENGER INFORMATION FORM.
